Terms of Participation
Interested parties must meet the specific requirements and conditions according to the respective tour description with regard to fitness, riding technique, bike equipment and specific clothing. By registering, the person booking confirms that they are healthy and that they are not aware of any heart, circulatory or respiratory diseases. Any severe allergies (e.g. to insect bites) must be reported to the organizer when booking and to the guide before the start of the tour or course without being asked. The participant is responsible for taking medication to maintain their health. Mountain bike tours can only be started with mountain bikes. Participants who obviously do not meet these requirements may be excluded from the tour in whole or in part by the responsible guide without being entitled to a refund of the tour price/participation fee for the workshop/bike camp. For safety reasons, helmets are compulsory on all tours organized by us. This must meet the requirements for cycling and must be in perfect technical condition (e.g. no damage from previous falls). Participants without a suitable MTB helmet must purchase an MTB helmet on site at the first opportunity. Before that, you are not entitled to participate in the tour. Furthermore, the use of appropriate protective equipment (gloves, protectors, etc.) is recommended as appropriate for the tour. All participants in our workshops, tours and bike camps must ensure that they have valid accident insurance that covers the consequences of a possible accident. Valid liability insurance is also required, which covers damage that they could cause to third parties. You also agree that photos and videos of the tours and technique training sessions with your participation may be published on the website/social media and that you therefore waive copyright.
Liability
Mountain biking is a risky sport! Participation is at your own risk. The participant declares that they are aware of the risks and dangers of mountain biking in detail. Participation in guided tours or any other sporting activities is at your own risk and without any competitive character!
Participation is at your own risk. The organizer and its guides are not liable for damage to property or personal injury or loss of items. The participant is obliged to adjust their speed and actions (driving on sections) according to their personal riding ability. If in doubt, the participant must inspect such areas beforehand in order to reduce the risk of accidents to a minimum. When using public roads, the traffic regulations must be strictly followed. When riding off-road, you should always expect unforeseen circumstances; corresponding and forward-looking driving is expected from every participant. Every participant must be aware of the existing risks, which cannot be completely ruled out even with careful supervision by the tour guide. We are not liable for damage caused by failure to follow the instructions of the tour guide or due to non-compliance with the respective traffic regulations. We are also not liable for disruptions in services in connection with services that are merely brokered by us as external services.
Each participant waives all legal claims against Plose Bike and its guides. The organizer assumes no liability for the loss and for damage to/of bikes and material. By participating, each participant acknowledges this disclaimer of liability towards Plosebike and its guides and its partners. Route suggestions, material recommendations, training suggestions or similar, which are made as part of the website presentation (homepage) of the organizer, are made exclusively from a sporting, comradely point of view and represent the individual's own non-binding and unverifiable opinion. Following such sporting, comradely opinions is exclusively at your own risk. Resulting health damage, other damage, legal or administrative prosecution do not justify any liability whatsoever towards the association, its bodies or its members.
Services and Price Changes
We reserve the right to make changes to services after the contract has been concluded for important reasons: In particular, program or tour adjustments due to external circumstances or group performance. We also reserve the right to change prices for unforeseeable reasons. Price increases of more than 5% entitle the participant to withdraw from the contract free of charge. Vouchers are valid for three years (statutory limitation period) from the date of purchase and have a price guarantee for one year. If a price increase occurs after one year, the voucher holder must pay the difference before the start of the event. There is no entitlement to a refund of the voucher value.
Payment
The price for the guided tours/workshops/bike camps or similar must be paid to Plose Bike or to the respective partner companies before the start of the tour. A deposit must be paid for multi-day tours. Payment is made in cash or to the account specified by Plose Bike. For workshops, the participation fee must be transferred to Plose Bike or to the respective partner companies no later than 4 weeks before the start of the course. The participation reservation only becomes effective upon receipt of payment. In the event of overbooking of the workshop, we reserve the right to exclude participants without receipt of payment from participation. Cancellations up to 8 weeks before the booked date are free of charge. The cancellation fees are staggered as follows: less than 8 weeks before the date 50% of the seminar fee, less than 2 weeks before the date 80% of the seminar fee, less than 1 week before the date or without cancellation 100% of the seminar fee. If the canceled place can be filled by a successor, no cancellation fees will be charged.
General
Participants who do not follow the instructions of the responsible guides despite verbal warnings will lose their right to participate in the tours. This mainly concerns unauthorized driving ahead, behavior in the event of loss of visual contact at the end of the group and risky driving behavior towards other participants. Tours are carried out in all weather conditions, with the exception of thunderstorms or heavy rainfall. Tours, workshops or bike camps that are interrupted or canceled due to dangers caused by striking weather do not entitle you to a refund of the price or parts thereof.
The organizer reserves the right to cancel or postpone tours before the start in the event of bad weather forecasts. If a booked tour, workshop or bike camp cannot take place, e.g. due to health reasons of the guide, an scheduled tour, workshop or bike camp must be canceled or postponed due to falling below the minimum number of participants, the participant is not entitled to compensation. The participant can reclaim the participation fee. If a partial service has already been provided (varies depending on the service), the participant can reclaim the fee proportionally.
Data Protection
When booking, the participant must provide the organizer, and the guide for riding technique courses, with their telephone number (including mobile) for any queries. For any emergencies, the telephone number of a contact person (e.g. relatives) who should be informed must also be provided.
